Should I return it or get it fixed?

Is the truss rod adjusted correctly? I see that the fret looks high but if there is excessive bow in the neck it may do this as well. I agree that a new guitar of this price point should be flawless but setup issues are possible. If it’s not that then yes, send it back to the dealer and let them deal with it.

I just opened up the box to a brand new PRS Modern Eagle V and noticed some buzzing and I found this. It's acually on a few frets.
I'm trying to figure out if I should just return the guitar or send it back to the factory and get it fixed.

I guess an excessive neck bow too.

Maybe due to wood's assessments during the trip from the factory to your home.

Did you let the guitar settle for few hours in its new environment?
